1. Introduction and Agreement

Welcome to Summit Container Crew Pty Ltd (ABN 93 701 251 112). By engaging our container unpacking, de-vanning, palletising, and warehouse labour services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before booking any services with us.

2. Definitions

  • "Company", "We", "Us", or "Our" refers to Summit Container Crew Pty Ltd.
  • "Client", "You", or "Your" refers to the corporate entity, business, or individual engaging our services.
  • "Services" refers to container de-vanning, unpacking, manual handling, sorting, palletising, stretch-wrapping, and general warehouse labour provided by us.
  • "Site" refers to the designated warehouse, dock, or yard nominated by the client where services are to be performed within the Perth metropolitan area or regional Western Australia.

3. Quotations and Pricing

All quotations provided by Summit Container Crew Pty Ltd are valid for thirty (30) days from the date of issue unless otherwise specified in writing. Prices are calculated based on container size, cargo type (floor-loaded vs palletised), estimated volume, and expected site conditions.

Unless expressly stated otherwise, all quoted figures exclude Goods and Services Tax (GST), which will be added at the applicable statutory rate. Additional charges may apply for waiting time caused by delayed container arrivals, inaccessible docks, or unsafe working conditions.

4. Client Responsibilities and Site Safety

The Client warrants that the nominated site complies with all relevant Western Australian Work Health and Safety (WHS) legislation. The Client is responsible for:

  • Providing a safe, well-lit, and structurally sound working environment for our crew members.
  • Ensuring containers are safely positioned, chocked, and structurally sound for unpacking.
  • Disclosing any hazardous materials, unstable freight, or unusual weight distributions prior to work commencement.
  • Providing necessary material handling equipment (such as forklifts and pallet jacks) unless otherwise agreed upon in the service contract.

Our team reserves the right to suspend operations immediately if hazardous conditions arise without penalty to the Company.

5. Payment Terms

Invoices are issued upon completion of the scheduled service or on agreed weekly billing cycles for recurring commercial contracts. Payment must be remitted strictly within fourteen (14) days from the invoice date, unless alternative credit terms have been formally approved in writing by management.

Late payments may incur interest charges calculated daily at the rate of 1.5% per month on overdue balances, alongside recovery costs incurred in pursuing outstanding debts.

6. Cancellations and Postponements

Cancellations or booking postponements must be notified to our operations team at least twenty-four (24) hours prior to the scheduled start time.

Failure to provide adequate notice may result in a call-out cancellation fee equivalent to the minimum shift booking for the allocated crew members.

7. Liability and Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with services, you are entitled to cancel your service contract with us, and to a refund for the unused portion or to compensation for its reduced value.

Summit Container Crew Pty Ltd maintains comprehensive Public Liability and Workers' Compensation insurance. Any claims for cargo damage or loss attributed to our handling must be reported in writing within forty-eight (48) hours of container completion, accompanied by photographic evidence.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Western Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
